4.12.010 Definitions.

Whenever used in this chapter unless the context otherwise requires:

(1) "Alcoholic beverage" means and includes any and all distilled or rectified spirits, potable alcohol, brandy, whiskey, rum, gin, aromatic bitters, beer, wine and every liquid or solid containing alcohol capable of being consumed by a human being;

(2) "Alcohol" means ethyl alcohol, hydrated oxide of ethyl or spirit of wine from whatever source or by whatever process produced;

(3) "Beer" means and includes any fermented beverage of any name or description manufactured from malt, wholly or in part, or from any substitute therefor and shall include such liquors as porter, beer, ale, and stout;

(4) "Liquor board" means the board of county commissioners, sheriff and district attorney of White Pine County, Nevada;

(5) "Convicted" means a finding of guilt resulting from a plea of guilty, the decision of a court or magistrate or the verdict of a jury, irrespective of the pronouncement of judgment or the suspension thereof;

(6) "Dining room" means a place which is regularly and in a bona fide manner used and kept open for the serving of meals to guests for compensation and which has suitable kitchen facilities connected therewith complying with all regulations of the Department of Health of the state of Nevada and in which alcoholic beverages are not served over a bar or counter and are served only in connection with the service of meals;

(7) "Fraternal club" means an organization of persons engaged in keeping, conducting and maintaining an establishment solely for bona fide fraternal, social, recreational, benevolent or athletic purposes and not for pecuniary gain and which does not traffic in alcoholic beverages profit and which disposes of alcoholic beverages to its members or bona fide guests only and which does not maintain or possess a public bar or place for the sale of alcoholic beverages to the public;

(8) "License" means a license issued pursuant to this chapter;

(9) "Licensee" means any person to whom a license has been issued pursuant to this chapter;

(10) "Package" means any immediate container of alcoholic beverage which is filled or packaged by the manufacturer or bottler thereof for sale by such manufacturer or bottler;

(11) "Person" means an individual;

(12) "Premises" means any and all places connected with and accessible to the licensed business;

(13) "Retail sale" or "sale at retail" means a sale to a consumer or to any person for any purpose other than for resale;

(14) "Retailer" means any person who sells at retail any alcoholic beverage;

(15) "Retail establishment" means a place where intoxicating, spirituous, malt or fermented liquors, wines or beer, are sold in quantities of not more than four and nine-tenths gallons;

(16) "Sale" means any transfer, exchange or barter in any manner or by any means whatsoever for a consideration and includes to solicit or receive an order for, to keep or expose for sale and to keep with intent to sell and shall include delivery of any alcoholic beverage in White Pine County;

(17) "Wholesaler" means any person who sells at wholesale only any alcoholic beverage;

(18) "Wholesale sale" or "sale at wholesale" means a sale to any person for purposes of resale;

(19) "Wine" includes the words "fruit juice" and means all alcoholic beverages obtained by the fermentation of the juice of grapes or other fruits or other agricultural products and which does not contain more than twenty-four percent alcohol by volume. (Ord. 1 §1, 1954).
